FULL 5 SEASON GUARANTEE WITH
ADDITIONAL 25 YEAR LIMITED WARRANTY

1. This Guarantee/Warranty is extended to the original purchaser (consumer) only.

2. CRESTWOOD POOLS, INC. for 5 seasons from the date of purchase, fully guarantees the wall components, cable assemblies, cable lugs, coping, wall foam and all hardware to be free from defects in material or workmanship.

3. If any defect in material or workmanship is confirmed by the dealer and/or CRESTWOOD POOLS, INC. within the guarantee or warranty period, the part(s) will be replaced free of charge for the first 5 seasons or for the appropriate prorated amount for the 6th - 30th seasons.

4. If a suspected factory defect is encountered, the purchaser must be willing to return the part(s) to the dealer location or to CRESTWOOD POOLS, INC. for inspection, and must bear the expense of cleaning, packaging and shipping incurred with this requirement. Only after receiving prior written authorization from CRESTWOOD POOLS, INC. may parts be returned to CRESTWOOD POOLS, INC. for inspection and/or replacement. Parts returned to CRESTWOOD POOLS, INC. must be accompanied by a proof of purchase date.

5. This Guarantee/ Warranty is void if the design of this product is in any way altered. This pool is designed to be installed as an above-ground pool. Burying any portion of the wall or other components below ground surface level voids all Guarantee/Warranty. CRESTWOOD POOLS, INC. is in no way involved in or responsible for pool installation. Under no conditions will CRESTWOOD POOLS, INC. be held liable for the cost of labor, water or chemical loss, or any damages that may thus occur. Pool installation must conform to all requirements as described in the installation manual included with all pool kits.

6. CRESTWOOD POOLS, INC’s. sole and exclusive liability for defect in material or workmanship shall be limited to repair or replacement at CRESTWOOD POOLS, INC. factory. CRESTWOOD POOLS, INC. shall in no event be liable for cost of water/chemical replacement or any other cost incurred due to removal or reinstallation of defective parts or components.

7. Any damage caused by accident, consumer abuse and neglect, improper use of chemicals, skimmer, return, or any other component, improper installation, unauthorized alteration or repair, vandalism, ice or ground heaving and movement or any other acts of God, will void this Guarantee/Warranty.

8. CRESTWOOD POOLS, INC. is not responsible or liable for any damage due to snow or ice formation leaning on or against pool wall, or any damage due to improper installation of winter cover.

9. To obtain performance under this Guarantee/Warranty, the purchaser should first contact the dealer from who the pool was purchased. The dealer is authorized to correct legitimate factory defects; however, he also has the responsibility of determining beyond a reasonable doubt that the defect was one created by the manufacturer.

10. Percentage of retail price at time of replacement to be paid by the original purchaser:

A season ends December 31st of each calendar year. See separate warranty for liner and wood components.

This warranty is made in lieu of any other Guarantee/Warranty or Warranties of any other kind whether expressed or implied or statutory, and except for the foregoing warranty which is exclusive, there is no expressed or implied warranties or merchantability or any other type.

To validate this warranty the registration card must be mailed within 10 days after the installation of the pool is completed.

WOLMANIZED RESIDENTIAL LUMBER REPLACEMENT POLICY

    Cox Wood Preserving Company has always stated that Wolmanized Lumber bearing the Cox stamp would remain undamaged from termites or decay that would make the lumber structurally unfit when used in the proper application in a residential structure.

    Cox shall be responsible for damage to lumber resulting solely from termites or decay. The original owner will be entitled to receive new Wolmanized Lumber by Cox in exchange for the structurally unfit lumber, not to exceed the number of board feet as shown on original purchase invoice. Cox shall not be responsible for the natural characteristic of some wood to check, warp or twist, or for any incidental or consequential damages, or for damages resulting from any cause other than termites or decay. Cox shall not be responsible for damages to Wolmanized Lumber used in foundation systems (such as the Permanent Wood Foundation and piling, pole or heavy timber type residential construction).

FIFTEEN YEAR LIMITED WARRANTY

Pocono Pool Products warranties this liner to the original purchaser against defective workmanship and weld separation for a period of fifteen (15) years, prorated after the first year.

THIS WARRANTY IS SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS

A. This warranty does not apply to fading, cuts, punctures, tears, or any damage caused by abuse (physical or chemical), ice, high water table, or improper installation.

B. The materials used in Pocono Pool Products liners are not produced by Pocono Pool Products. Any claim of failure deemed due to material defect should be forwarded to the manufacturer of said material. The name and address of the material manufacturer may be obtained from our factory by supplying us with the serial number of the liner in question.

C. This liner warranty is enforceable only by the original retail customer and applies only to liners purchased for private residential use.

D. In order to insure the maximum life expectancy of your liner, your pool should be kept full of water at all times. We are not responsible for any damage, imperfections, or irregularities that may occur should the water be removed from the liner.

E. This warranty is limited to repair or replacement and does not include consequential damage or installation expenses, and is in lieu of any and all other warranties, either express or implied. The following schedule sets forth the cost for repair or replacement based on the retail cost at the time of repair or replacement. The percentages are based on the length of time you have owned the liner measured from the time of installation.

F. If a Pocono Pool Products liner should fail during this warranty period as a result of a problem covered by this warranty, send a letter to our factory describing the problem. Please include the liner serial number, installation date, and a day time phone number. We will then promptly contact you and advise you as to the best way to proceed with your claim.

G. Our warranty center is located at P.O. Box 727, Swiftwater, PA 18370, and is open for business Monday through Friday between 8:00 A.M. and 5:00 P.M.

H. Freight costs for any liner returned to us must be prepaid by you. Freight costs for shipment of a new liner must also be paid by you.

I. Repair or replacement covered by this warranty will be completed within fourteen (14) working days. Should the defect not be covered by warranty, a written explanation will be provided to you.

CRESTWOOD POOLS, INC.WINTER COVER WARRANTY

   Crestwood Pools, Inc. winter covers are warranted to be free from defects in materials and workmanship for a period of two years from the date of purchase. Punctures, tears, or failure resulting from failure to remove dirt, debris or water from the surface of the cover are specifically excluded from coverage under this warranty.

   Should you suspect a defect in your cover please contact us at Crestwood Pools, Inc., at 220 Stage Road, Vestal, NY 13850, (607)786-0010, for authorization to return the cover for inspection which may result in repair or replacement depending upon our findings. Winter covers will NOT be accepted without prior Authorization from Crestwood Pools, Inc.
